Terms of Service

Welcome to AfyaForce. These Terms of Service ("Terms") govern your use of the AfyaForce platform, mobile application, and website (collectively, "the Platform"), operated by AfyaForce Limited, a company registered in Kenya (company number 12345678).

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform.

• "Provider" means a registered healthcare professional using AfyaForce to find and accept shift work.
• "Facility" means a healthcare organisation, hospital, clinic, or similar entity using AfyaForce to post shifts and hire Providers.
• "Shift" means a specific work engagement posted by a Facility and accepted by a Provider through the Platform.
• "Platform Fee" means the fee charged by AfyaForce to Facilities for each successfully completed Shift, currently set at 8% of the Shift value.

3.1 Healthcare Providers

To register as a Provider, you must: (a) hold a valid, current licence issued by a recognised Kenyan regulatory body (e.g. Nursing Council of Kenya, Kenya Medical Practitioners Board); (b) be at least 18 years of age; (c) have the legal right to work in Kenya; and (d) maintain all required professional indemnity insurance.

3.2 Facilities

To register as a Facility, you must: (a) be a legally registered healthcare organisation in Kenya; (b) hold all required operating licences from relevant Kenyan authorities; and (c) designate an authorised representative to manage the account.

You agree not to: circumvent the Platform to hire or work outside AfyaForce after making a connection through it; provide false credentials or misrepresent your qualifications; harass, abuse, or discriminate against other users; use the Platform for any unlawful purpose; reverse engineer or copy any part of the Platform.

AfyaForce processes all payments between Facilities and Providers. Providers receive payment within 48 hours of shift completion subject to clock-out verification. Facilities are billed weekly via invoice. The platform fee is 8% of the gross shift value, added on top of the Provider's agreed rate. AfyaForce reserves the right to adjust fees with 30 days' written notice.

Providers may cancel a confirmed shift without penalty if cancellation occurs more than 4 hours before the shift start time. Cancellations within 4 hours will result in a warning, and repeated late cancellations may result in account suspension. Facilities that cancel confirmed shifts within 2 hours of start time may be charged a 25% cancellation fee of the shift value.

All content, trademarks, logos, and software on the Platform are the property of AfyaForce Limited or its licensors. You may not reproduce, distribute, or create derivative works without express written consent.

AfyaForce acts as a marketplace connecting Providers and Facilities. We are not an employer of Providers and are not responsible for the quality of clinical care delivered. Our total liability shall not exceed the total fees paid by you in the 3 months preceding any claim.

Either party may terminate their account at any time. AfyaForce may suspend or terminate accounts that violate these Terms, provide false credentials, or engage in conduct harmful to other users or the Platform's reputation.

These Terms are governed by and construed in accordance with the laws of Kenya. Disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
